Burn Ordinances

The burn ordinance will vary based on where you live within the District. Those that live in unincorporated Hampshire may have a different ordinance than those who live within the Village limits. Below are the highlights of each ordinance as well as a link to take you to the full version. 


Be advised, the Hampshire Fire Protection District does not create these ordinances, however, we are obligated to help enforce them with the assistance of the Police Department.


Residents living within Village limits:

  • ​It is unlawful to burn rubbish, leaves, refuse, construction debris, or garbage.
  • Only clean, dry brush shall be burned.
  • Burning must take place on sunny days between 10 am - 3 pm.
  • Burning may not take place if wind speeds are greater than 10 mph.
  • Burning must be supervised at all times with a garden hose or extinguisher readily available.
  • Burning may not take place on ozone alert days.

Residents living in unincorporated Hampshire:

  • ​Burning must take place on sunny days between 10 am - 3 pm.
  • Burning may not take place if wind speeds are greater than 10 mph.
  • Burning may not take place on ozone alert days.
  • Burning may not take place within 20 feet of a building or a property line.
  • Burning must be supervised at all times with a garden hose or extinguisher readily available.
